The legislator uses the term negligence in criminal law, among other things, for the offenses of negligent homicide and negligent bodily injury, without defining it in more detail. This raises the question of how the concept of negligence should be defined. At the same time, there are numerous written non-criminal rules of conduct that are established by both the state and private institutions. This thesis is primarily concerned with the question of whether a binding orientation towards state or private regulations is possible in order to justify an allegation of negligence, particularly in consideration of constitutional law.
