Die Beschulung längerfristig kranker Schülerinnen und Schüler als Herausforderung des öffentlichen Schulorganisationsrechts

This doctoral thesis is pioneering in the field of law that regulates bedside-teaching and home-schooling for seriously ill pupils. Although correspondent regulations can be found in every German federal state there the field was lacking jurisprudential research.
The thesis generates and centers around an analogy of these legal structures. This is due to the fact, that the constitutional right to education - generally understood as a right to participate – can’t tackle the necessity of individual education that is caused by illness. It therefore concentrates on generating and processing the legal material to make it accessible for further research. By contrasting the varying legal arrangements in the German federal states different legislative approaches and substantive standards can be identified and categorized.
