Die Bestimmung der internationalen Zuständigkeit und ihre gezielte Beeinflussung durch forum shopping unter der reformierten EuInsVO

The dissertation examines the extent to which the European Insolvency Regulation (EIR) recast has achieved its self-imposed objectives of creating a clearer framework for determining the international jurisdiction of insolvency proceedings and adequately regulating the phenomenon of insolvency-related forum shopping. The work analyses the forum shopping endeavours of both natural persons and companies and also takes a look at the effects of parallel developments in the area of international insolvency law on the conditions for forum shopping in Europe, such as the EU-Restructuring Directive or Brexit.
