On the occasion of the bi-national project of the SES, the author outlines a conceptual framework for a genuine supranational legal form, which is intended to facilitate SMEs' access to the European internal market.
In this context, the author analyzes the possible additional value of such a legal form and deduces consequences for the concrete design. Finally, the conclusions thus gained are contrasted with the recently published draft for the creation of an SES statute.
