Die digitale Inhaltsdokumentation der strafgerichtlichen Hauptverhandlung

Currently, there is no complete recording of the content of criminal court hearings. Instead, those involved in the proceedings are required to take their own notes. This paper therefore examines whether digital content documentation, i.e., the recording of court proceedings with the aid of technical equipment, can counteract this problematic situation. In particular, it analyzes how an (audio-visual) recording can be used, what risks are associated with it, and how it could be implemented. The (failed) draft of a main hearing documentation law („Hauptverhandlungsdokumentationsgesetz”) is taken into account in detail.
