The treatise examines if and how private law instruments can contribute to the enforcement of capital market regulations on the secondary market.
To date, German capital market law is mainly enforced by public authorities using administrative and criminal sanctions. However, in the EU private enforcement is increasingly brought to the agenda within academic discussions. The treatise assesses whether capital market regulations are already enforced by use of private law instruments and whether private law instruments should be implemented to enforce capital market law.
