Die einstweilige Wahlabbruchverfügung auf Antrag des Arbeitgebers bei anfechtbaren Betriebsratswahlen

The question of the conditions under which an ongoing works council election can be cancelled is controversial. The decision of the Federal Labour Court of 2 July 2011 did nothing to change this. Contrary to the view expressed there, the author is of the opinion that an election can be cancelled even in the case of contestable elections. Against this background, the work critically examines and recognises the state of opinion in literature and case law and provides its own justifications. Finally, the work examines a wide range of conceivable infringements of the provisions of the “Betriebsverfassungsgesetz” and the “Wahlordnung zum Betriebsverfassungsgesetz” and analyses whether these can justify the cancellation of an election.
