Contributing to the ongoing discussion of judicial deference to regulatory decisions, this work analyzes the relevant decision-making problems in ex ante efficiency-cost regulation in the telecommunications and energy sector. It includes businesses’ and regulatory authorities' vantage points. At the interface between economics and law, the work highlights typical margins of discretion for determining what efficient costs are. A profound analysis of the substantive requirements of ex ante rate regulation already delivers guidelines for a basic allocation of competences and the exercise of discretionary powers in accordance with those guidelines. Most importantly, the work develops and explains which concrete criteria have to be applied to ensure an appropriate level of review - particularly with regard to mathematical model calculations and methods of economic prognostics.
