Die Erbengemeinschaft mit instandsetzungsbedürftigem Nachlass

Due to the demographic development the number of inheritances in Germany is increasing. About 80% of inheritances are left to a community of heirs. These are particularly challenging if the estate requires investments while the interests of the co-heirs differ because of different financial standing and social situation. The Civil Code lacks detailed regulations regarding the community of heirs.
This doctoral thesis outlines the legal framework concerning the German community of heirs. It focuses on the special situation of estates requiring investments and the different interests of heirs in diverse financial and social situations. It covers in particular majority rights, cost distribution, internal compensation, minority rights and opportunities of testamentary dispositions.
