Description
This work addresses the issue of the duty of the heir to look after the assets of his co-heirs. The spectrum of opinions is presented and the civil and criminal law classification of the estate within the community of heirs is analysed. Building on this, the individual characteristics of an heir's duty to take care of property under Section 266 of the German Criminal Code are examined, outlining the understanding and requirements profile in case law and literature. In particular, the criterion of the heir's scope for decision-making in estate care is evaluated in detail and a separate assessment approach for determining the specific independence is elaborated.
