Are the OECD Guidelines for Multinational Enterprises hard or soft norms? To answer this question, this book takes stock of instances where the Guidelines, now fifty years old, are hardening. It identifies and analyses instances of hardening in relation to the Guidelines’ implementation procedure operated by the National Contact Points and the OECD’s Investment Committee, their legally binding nature, their interaction with legally binding instruments and their degree of precision. This latter aspect requires the examination of hundreds of statements by the National Contact Points and the Investment Committee to ascertain whether a coherent jurisprudence can help answer previously under-researched questions of the Guidelines.
