Die Flexibilität des Pflichtteilsrechts

This work examines reforms of the law of compulsory shares (forced heirship) in Germany's neighboring countries. It compares various regulations and reforms with the rules of German law in order to ultimately propose a reform of the German system. To this end, German law is compared with French, Belgian, and Austrian law. These legal systems were chosen because Austria and Belgium have already reformed their laws on compulsory shares, and an expert opinion has already been obtained in France. Accordingly, the jurisdictions examined provide an indication of what legislators consider necessary and useful for the future.
