Die geographische Schiedsfähigkeit des Unionskartellrechts

The work analyzes the interplay between arbitration and the enforcement of EU competition law, particularly in cases where ex post control based on EU competition law fails. Practical examples are arbitration venues in Switzerland, which have recently been the subject of ECJ decisions in sports law. Against this background, the author develops the concept of geographical limitations on arbitrability and examines its enforcement. Additionally, the introduction of anti-arbitration injunctions is discussed. The work is aimed at scholars and practitioners in the fields of competition and arbitration law.
