Description
Legal gender recognition is often surrounded by controversial debates. The author contributes to these by situating gender identity as a human rights issue which concerns the right to self-determination just as much as the right to equality.
The study examines national, regional, and international human rights jurisprudence and criticises that legal gender recognition is predominantly understood as a matter of individual freedom and privacy. Equality rights on the other hand are often neglected. To improve the protection of gender identity under human rights law the author proposes a comprehensive approach which simultaneously reflects freedom and equality rights.
