Die Gestaltbarkeit von Arbeitsbedingungen im Rahmen von § 9 Nr. 2 AÜG

To which extend are the parties to a collective agreement or to an employment contract free to design employment conditions in the scope of the application of § 9 Nr. 2 AÜG? The thesis defines the boundaries of § 9 Nr. 2 AÜG especially with regard to the existence of immanent boundaries. The possibilities of an individual deviation from the applying collective agreement are examined exemplarily according to their compatibility with § 9 Nr. 2 AÜG. Furthermore, the thesis analyses which provisions are applicable in case of a violation of § 9 Nr. 2 AÜG.
