Die gleichgeschlechtliche Ehe in Deutschland

In this volume, Corrado Becker ventures to take an overall legal view of same-sex marriage and presents the topic in a comprehensive constitutional and comparative legal context. In addition, the legal-historical development of marriage and homosexuality over the centuries is traced; comparative legal remarks place the issue on a broader foundation. From this broader context, the possibilities and limits of a further development of constitutional provisions, such as the concept of marriage in the Basic Law, are described and recontoured. On this basis, the constitutionality of the Marriage Opening Act, the so-called “marriage for all”, is addressed.
