The treatise addresses liability risks for Mittelverwendungskontrolleure and examines the underlying legal doctrine. The examination reveals inconsistencies in the derivation favoured by the German Supreme Court (BGH) by means of a third-party beneficiary contract, especially when it comes to liability limitations and their judicial control. The comparison with other scenarios of liability towards third party (Vertrag mit Schutzwirkung zugunsten Dritter and Bürgerlich-rechtliche Prospekthaftung) unveils a doctrinal deficiency in a derivative protection of third parties. A unified “Vertrauenshaftung” based on Sec. 311 par. 3 clause 2 BGB eliminates these deficits without altering the generally accepted results.
