Description
This dissertation provides legal certainty for all stakeholders in autonomous mobility – from legislators and manufacturers to insurers. It demonstrates that existing liability law offers sufficient victim protection for accidents involving fully autonomous vehicles (SAE Level 5), rendering fundamental legislative changes unnecessary. Methodologically, the study systematically examines liability of owners, users, and manufacturers from the victim's perspective, analyzing typical accident scenarios. In this context, the owner's strict liability under Section 7 of the German Road Traffic Act, combined with mandatory motor vehicle insurance, remains the cornerstone of the liability system.
