The debate surrounding the integration of the European capital market under the banner of the Capital Markets Union is gaining momentum. This paper aims to contribute to the harmonisation of insolvency law, with a particular focus on the two largest European economies. To begin with, a consensus must be reached on the objectives of the insolvency proceedings. The fact that diametrically opposed positions often clash in Germany and France is revealed in great detail through an examination of Franco-German law on avoidance actions. The author practises as a solicitor specialising in insolvency administration.
