Description
The four instruments of section 29 of the German Restructuring Act (StaRUG) form the core of the new preventive restructuring framework. The dissertation examines the similarities and differences between these instruments and the U.S. Chapter 11 proceedings as well as the comparable English proceedings (CVA, SoA and Restructuring Plan). Also included is the termination of contracts, which was provided for in the draft versions of the StaRUG. Many similarities but also differences between the procedures are shown. With regard to some aspects, however, the study identifies deficits in German law and a corresponding need for reform – especially taking into account practical considerations.
