The law governing general terms and conditions has a strong influence on German civil law. More than twenty years after the modernization of the law of obligations in 2001, Felix Braun provides a systematic reassessment of the integration of the German Act on Standard Terms and Conditions (AGBG) into the German Civil Code (BGB). Based on the principles of the BGB and the AGBG, he examines whether and how this integration should have taken place and shows that the integration was not only appropriate but also necessary. While the integration is generally convincing, its legal structure reveals shortcomings in systematic coherence and clarity, which are addressed with a proposal for systematic reorganization.
