Die Investitionsplanungs- und Investitionspflichten der Übertragungsnetzbetreiber

There is a significant need to expand and develop the transmission network. The increasing share of renewa-ble energies and the corresponding changes in the generating landscape are key reasons for this. Against this background, the transmission system operators’ obligations to expand their grids and the corresponding planning obligations, especially via the network development plan, are subject of this thesis. The core issue that is addressed here is the conflict between the powers of regulatory authorities on both levels and the transmission system operators’ entrepreneurial autonomy. Especially the aspect of enforceability in cases of insufficient progress has hardly been addressed in legal literature. Further focusses are the European law background and the mechanism for refinancing investment costs via network charges.
