This dissertation discusses the potential of a typified view of group companies as agents (“Verrichtungsgehilfen”) of their parent company in the meaning of § 831 BGB. With a view to trans-subjective tortious responsibility, for example along supply chains, the work provides clarification on the scope and limits within the group. Based on an economic analysis of the principle of separate legal identity under company law and the basic principles of tort law, the liability of a parent according to § 831 BGB for damage caused by a subsidiary is specified in context of the criteria of §§ 17, 18 AktG. The dissertation concludes with a legal comparison to English common law.
