Despite the increasing importance of online platforms, manufacturers of luxury goods prohibit their authorized dealers from selling via third-party platforms. They justify this with the protection of the luxury image. Whether and to what extent such a ban is permissible under antitrust law is still unclear, despite the significant Coty judgment of the ECJ.
This paper deals with the different legal situations of selective distribution systems for cosmetics and other luxury products in Germany, the EU and South Korea and their assessment under antitrust law.
Furthermore, it critically examines to what extent the regulation of selective distribution systems with regard to online trade by the Vertical Block Exemption Regulation is up to the digital age.
