Die klageberechtigten Stellen nach dem Verbraucherrechtedurchsetzungsgesetz

The subject of the study is the legal standing and the legal status of qualified entities under the German Consumer Rights Enforcement Act. The author proposes a purely procedural interpretation of legal standing, which should be classified as a special form of the right to conduct proceedings.
In addition to the dogmatic interpretation, the practical implications are also examined, in particular lis pendens, res judicata and binding effect, compatibility with Article 103(1) of the German Constitution, the legal relationship between the association and consumers and the suspension of the limitation period.
The study furthermore addresses on the Representative Actions Directive and the implementation alternatives to the VDuG.
