Social networks offer dimensions of information exchange that cannot be implemented in real life in such as effective way of networking due to the possibility of the rapid spread of messages and linking of users. Often, people no longer just discuss, but are exposed to, insulted, called to commit crimes or to engage in rightwing extremist propaganda. In social networks, a large audience can be found. Numerous people can perceive, comment on and support the actions.
The subject of this work are the problems of criminal law dogmatics that arise when comment on status reports with illegal content in social networks and whether these comments do justice to the specific characteristics of the media. The question of a possi-ble criminal liability when commenting on status reports in social networks has long since ceased to be a theoretical problem, but is one that has already arrived in the courtrooms. Liking, sharing, commenting; all this is now part of everyday communication and is even done several times a day in different contexts. This can result in criminal consequences, as the internet is not a lawless area.
