Die Kompetenzen nationaler Gerichte bezüglich beihilferechtlicher Fragestellungen am Beispiel der deutschen Gerichtsbarkeit

The enforcement of EU State aid law rests on a dual system: while the European Commission decides on the compatibility of aid with the internal market, it falls to the national courts to safeguard the directly applicable standstill obligation laid down in the last sentence of Article 108(3) TFEU. Case law and legal scholarship largely assume that the courts have the instruments they need, but leave the doctrinal basis of those powers unexamined. This work determines the powers of application, interpretation and remedies held by the German civil and administrative courts, and examines how proceedings before the Commission shift those powers.
