Description
What rules govern (plastic) waste shipments from Japan and Germany? The author shows how two of the largest economies and export countries implement the Basel Convention and transpose international waste shipment law into their respective legal systems. It is shown that Japanese law and EU law have traditionally followed different concepts of what is “waste”. Furthermore, Japan does not establish absolute export bans and sets different rules on the re-import and sanctioning of illegal waste exports. Despite common international standards, Japan and the EU also choose different ways to determine which plastic wastes are subject to the 2019 Plastic Amendment to the Basel Convention.
