The work provides a comprehensive copyright assessment of artificial intelligence under current legislative frameworks, from development to generative use. It also offers a critical classification of recognizable or derivable reform efforts from legal, dogmatic, and economic perspectives.
The analysis covers the permissibility of training and the protection of training results and generative products, as well as the possible legal consequences of infringing copyrighted works. Key concepts analyzed include the German and European concepts of "work" and "the right of reproduction”, as well as the applicability and scope of text and data mining and pastiche exceptions.
