Die Leistungserbringung in eigenen Einrichtungen der Renten- und Unfallversicherungsträger

The provision of services in the accident and pension insurance institutions' own facilities is an area of German healthcare with high practical relevance that has hardly been investigated to date. The author analyses whether the operation of own facilities is permissible and what legal relationships exist between these facilities and their providers on the one hand and the insured persons on the other. To find a solution, the author draws on principles and theories from general administrative law and draws parallels with municipal law and the law governing public companies. In addition, the provision of services in own facilities is assessed against the background of competition and public procurement law.
