The medical indication is a crucial component of medical decisions and holds significant importance for the legitimisation of medical interventions. Despite its importance, there is a lack of a definition and a comprehensive analysis of its role in medical liability law. This dissertation aims to fill this gap by examining the linguistic usage and the legal functions of the medical indication in medical liability case law and by developing a definition of the term based on these findings. The analysis of case law considers both substantive and procedural aspects.
