With the administration of estates in a community of heirs, the work is dedicated to a topic of central importance for legal practice. Embedded in the discussion of the administrative powers of co-heirs, the work focuses on the controversial possibility of majority action at the level of disposition. Taking into account the case law of the highest courts, an interpretation-oriented discussion takes place, which focuses in particular on the meaning and pur-pose of the regulations of § 2038 BGB and 2040 BGB that determine the administration of the estate. Based on the conflicting interests in a community of heirs, the work is structured according to various argumentation approaches and discusses the consequences of different interpretations.
