Description
The author examines the online foundation law of a joint stock company by discussing problems and solutions of cash and non-cash assets. In doing so, the foundation law of a joint stock company is examined step by step for its compatibility with the requirements of an online foundation. Among other things, the application of blockchain technology for online foundations with the participation of substitutes is discussed, but also whether it makes sense to establish sample statutes in the AktG. In the foundation law by depute non-cash-assets, the transfer of GmbH shares and real estate presents the legislator with solvable hurdles. Throughout the work, the author also offers legislative proposals de lege ferenda.
