Die Parteienfinanzierung vor dem Verfassungsgericht

How do constitutional courts shape parties' links to society? This study compares the jurisprudence of Germany's Federal Constitutional Court and Brazil's Supreme Federal Tribunal on party financing. Both courts pursue the same goal yet arrive at opposite outcomes. While the BVerfG acts as a dialogical guardian, promoting a liberal model with diverse funding sources, the STF operates as a paternalistic master of the constitution, paradoxically leading to near-complete state dependency. The study combines functional comparative law with political science perspectives. The author is a postdoctoral researcher at the Chair for Science and Innovation Studies at the University of Hamburg.
