Compulsory licences permit, in exceptional cases, the use of a patent against the will of the patent holder where the public interest requires such a limitation. This thesis examines the conflict potential of this instrument in relation to the protection standards of international investment agreements, including protection against indirect expropriation. At the same time, it develops substantive and procedural criteria for assessing compulsory licences under international investment law and analyses their interaction with other relevant legal regimes. In doing so, the study provides a framework for addressing the growing practical significance of compulsory licences on a sound legal basis.
