Die Pflicht zur Wahrung der Gläubigerinteressen nach § 43 Absatz 1 Satz 1 StaRUG

The duties of directors in restructuring proceedings present challenges for both academics and directors. With his thesis, the author contributes to a better understanding of the duty to safeguard the interests of creditors as set out in para. 43 (1) StaRUG. To this end, he examines the central concept of creditors’ interests and the necessity of safeguarding these interests in restructuring proceedings. Additionally, he determines the scope of the duty to safeguard creditors’ interests and examines its relationship to other duties of directors.
