Description
Cooperative multi-party agreements between three or more building parties, so-called "alliance agreements" or "multi-party agreements", have been on everyone's lips in recent times. These are called partnering, alliancing or IPD and promise high savings and thus an economical handling of complex construction projects. However, little is known about the content of these contracts, how they differ from classic contracts and why more than just new contracts are needed. There is no case law on this subject so far.
For the first time in German-speaking countries, the author presents foreign example contracts from all countries of origin in detail and explains how they can be implemented in Germany. The focus is on the type of contract and the contents of new contracts. For this purpose, a double-digit number of multi-party contracts was evaluated.
The author Julius Warda has been researching the legal conditions and variants of multi-party contracts since 2018.
