Die rechtliche Einordnung des privaten Kilometerleasingvertrags

Divergent court rulings have given cause to legal uncertainty in the German leasing industry as to the proper notification of consumers with respect to their right of withdrawal from mileage-based leasing contracts – with considerable implications: The consumer has a prolonged or even “eternal” withdrawal rightand without any obligation by the lessee to pay compensation. This monograph examines the contractual classification of the mileage-based leasing contract on the basis of model contracts as well as the questions referred for a preliminary ruling by the the ECJ and is of practical relevance for leasing experts.
The author works at an international law firm in commercial and distribution law and advises leasing companies, among others.
