The right-preserving use of a trademark in the course of commerce is essential for its continued existence. Unused trademarks are subject to revocation and cancellation after the grace period for non-use has expired.
Taking this period into account, this work addresses the current challenges of preserving the rights of use in modern, often long and confusing lists of goods and services. National and European case-law has come to different conclusions, so this work analyzes the case-law and identifies its critical points before finally presenting solutions for a more legally secure approach.
