Die Reduzierung der Verbandsgeldbuße im Bußgeldverfahren der BaFin im Rahmen der Wertpapieraufsicht

The dissertation examines the compatibility of the settlement procedure practiced by BaFin with the applicable law on administrative offenses and looks comparatively at the advantages of the Deferred Prosecution Agreements (DPAs) established in the U.S. and the U.K. to show an alternative to the embedding of settlements in the law on administrative offenses. This topic is important both against the background of the discussion about the creation of a law on sanctions for associations and for the question of whether one should continue to be guided by the principle of establishing the truth ex officio or whether a turn to the practice of prosecution agreements prevailing in the Anglo-Saxon world should be preferred.
