Description
After pointing out the need for reform of the German criminal law on homicide, the author addresses the question of how §§ 211-213 StGB could be reformed on the factual and legal consequences side. On the legal consequences side, it is questionable whether the life sentence should be upheld or replaced by a term of imprisonment. With regard to the options for drafting the factual elements, a distinction is made between single-, two- and multi-level models. The results of the expert commission appointed by the BMJV in 2014 as well as the draft bill presented in 2016 are assessed. In addition to an analysis of the failure of the reform, a separate proposal is presented that abolishes the life sentence.
