Description
Frederic Kupsch offers a systematic analysis of the legal standards of the ECtHR and CJEU for the regulation of online platforms with regard to illegal content. He highlights similarities and differences in case law, examines trends and explores synergies. On this basis, he focuses on the question of whether social networks themselves can be bound by freedom of expression standards. Methodologically, he combines a case-group-oriented and comparative legal evaluation of case law with references to the ICCPR and an analysis of the Digital Services Act. Finally, the author concludes that both courts have a regulatory role to play.
