Die Reichweite der Fotografierfreiheit

The permissibility of producing and using photographic and video recordings is regularly the subject of higher court decisions. Time and again, it becomes apparent that an absolute freedom to photograph is not guaranteed, despite the constitutionally protected interests of photographers, videographers, and image users. Rather, the freedom to produce and use images is subject to various prohibitions on photography and image use, which in turn serve to protect different fundamental rights. This work examines the scope of the freedom of photography. It investigates whether existing law strikes an appropriate balance between the conflicting interests and develops concrete reform proposals.
