Company groups shape the economy – yet where are the boundaries of individual criminal and administrative liability regarding unlawful behaviour in subsidiaries? This thesis comprehensively examines the criminal law guarantor position (Section 13 of the German Criminal Code, StGB) and the supervisory duty under regulatory offence law (Section 130 of the Act on Regulatory Offences, OWiG) within company groups. It defines the requirements and limits of individual responsibility as well as the scope and substance of the duties to act and to supervise. Further, it analyses potential parallels to civil liability concepts. The thesis concludes with a concrete proposal for legislative clarification.
