Personal data are among the most important resources of the modern information society and are predominantly managed by multinational corporations. These data collections are primarily based on a data-for-service business model. In the past, the rapidly advancing technical development and the uncertain legal situation often led to a legal relationship between consumer and entrepreneur characterised by legal uncertainty and intransparency. This work analyses the newly created European legal framework and examines it with regard to tensions and regulatory gaps between contract law and data protection.
