Die Stellung der Frau im Agrarrecht

There are already some empirical studies concerning the societal position of women in the agricultural sector. Meanwhile, their legal status has not been researched yet. This paper closes this gap, considering and analysing the empirical data. The study focuses on the analysis, under constitutional law, of whether the agricultural privileges of family and inheritance law, having an especially adverse effect on women, indirectly discriminate against them and thereby interfere in article 3, paragraph 2 of German Basic Law. Additionally, the suitability of previous law reforms to improve the legal position of wives within the scope of the old-age provisions for agriculturalists will be examined. The study will be the basis and serve the objectification of the current legal policy debate about the role of women in agriculture, in which more than 90% of businesses are led by men.
