Description
This work is the first to examine the extent to which the social phenomenon of cyberstalking is covered under German criminal law. To this end, a criminal law definition is first developed based on existing sociological and empirical findings. Taking into account constitutional and European legal requirements, a comprehensive analysis of the relevant criminal offenses under current law follows. In addition to the central provisions of the German Criminal Code, for example Section 42 of the Federal Data Protection Act and Section 4 of the Protection Against Violence Act are also considered. The thesis concludes with various reform proposals aimed at ensuring the practical implementation of the victim protection intended by the legislature.
