Die Strafbarkeit von Menschenrechtsverletzungen durch Unternehmen

Business enterprises are repeatedly involved in human rights abuse within the course of their transnational activities. This work deals with the question of the extent to which corporate actors are responsible under German Criminal Law in the relevant cases. The potential of Criminal Law in terms of actus reus in global value chains is examined in detail and placed into context. Particularly, the study deals with the influence of human rights due diligence on the Criminal Law standard of care, its role in the delimitation of spheres of responsibility and the cross-company scope of principal’s criminal liability.
