16 years after 9/11, financial sanctions against individuals and organisations involved in terrorism have become an integral part of the legal framework in the fight against terrorism. Violating the embargoes imposed on terrorism must be punished with effective, commensurate and deterrent sanctions according to the EU’s regulations.
This study examines the penalties administered for violating the embargoes imposed on terrorism, as laid down in the sections of Germany’s criminal law relating to foreign trade. After placing the embargo in its historical and legal context, it first explains the complex structure of the information (‘Blanketttatbestand’) laid down in section 18, paragraph 1 of the Foreign Trade Law. It then examines the numerous individual and dogmatic issues which arise as a result of the interplay between German criminal law, EU law and international law.
