Die strafrechtlichen Grenzen der rechtfertigenden Einwilligung im Zusammenhang mit Placebo- und Nocebophänomenen

The knowledge of medical science about placebo and nocebo phenomena for therapeutic practice is continuously increasing. Nevertheless, the tension regarding the (criminal) legal framework continues to exist. In particular, the avoidance of undesirable nocebo phenomena has received little attention in the legal literature. The author examines how these phenomena can be integrated into the system of justifiable consent in medical criminal law. Based on the different medical objectives, the focus is on the context of the obligation of physicians to provide information.
